European Regulation on Artificial Intelligence

Introduction to the AI Law

The AI Law sets global standards for a technology in full development, anticipating the effects of a technology that is changing the world.

It will come into force in 2026, requiring the identification of content created with this technology and limiting applications considered “risky.” To achieve this, a legal framework is established for the development of reliable AI that safeguards security and fundamental rights.

This law will allow identification of generic content generated by such technologies, which must respect copyright. It also defines categories to prohibit the use of technologies deemed dangerous and sets standards for risk monitoring.

Prohibitions

It prohibits all biometric categorization systems based on political, religious, or philosophical beliefs, as well as on race or sexual orientation.

It also bans the “social scoring” tool that rates citizens according to their behavior and personal characteristics to determine their position in society.

In workplaces and schools, systems capable of recognizing emotions are banned. Additionally, systems are not allowed to expand or create facial databases using data indiscriminately collected from the internet or audiovisual recordings.

Exceptions

Certain exceptions are considered under strict safeguards, such as the use of facial and biometric identification to pursue serious crimes under a judicial order.

It will also be applied to prevent a foreseeable or ongoing terrorist threat, to locate or identify suspects of committing acts of terrorism, human trafficking, sexual exploitation, kidnapping, or environmental crimes, and to find the victims of these crimes.

High Risk

It defines AI systems that are authorized but considered very high risk due to their significant impact on health, safety, fundamental rights, the environment, and the rule of law.

Systems used to influence election outcomes and voter behavior are considered high risk. Citizens will have the right to file complaints and receive explanations about decisions made by high-risk AI systems that affect their rights.

Generative AI

It regulates generative AI systems, which must meet transparency criteria and specify whether a text, song, or photograph was generated by artificial intelligence. They must also ensure that the data used to train these systems respects copyright.

Penalties

Penalties for non-compliance range from 35 million euros or 7% of the company’s or sanctioned entity’s global turnover to 7.5 million euros or 1.5% of global turnover, depending on the company’s size.
